Terms of Service

These terms govern use of The Forge ("the Service"). By creating an account or using the Service you agree to them. If you use the Service on behalf of a company, you agree on that company's behalf and represent that you are authorized to do so.

The Service

The Forge is a construction management platform: estimating, proposals, scheduling, time tracking, safety compliance, document management and signing, invoicing, and related tools. Features may be added, changed, or retired as the Service evolves.

Accounts

  • You are responsible for your credentials and for activity under your account.
  • Company owners and managers control team roles, permissions, and what teammates can see.
  • Accounts are created by invitation of a company or by company sign-up.

Your data

  • Your company owns its data. Jobs, estimates, customers, photos, and records your company creates belong to your company, not to us.
  • You grant us the limited rights needed to host, process, back up, and display that data in order to run the Service.
  • Our handling of personal information is described in the Privacy Policy.

Acceptable use

Don't misuse the Service: no unlawful content, no attempts to breach security or access other companies' data, no interference with the Service's operation, and no use of the email features for spam or deceptive messages. We may suspend accounts that violate these rules.

Documents, signatures, and estimates

  • Electronic signatures captured in the Service are intended to be legally binding records between the signing parties; each record stores the signer, time, and document text signed.
  • Estimates, proposals, and calculations are tools that operate on the numbers and rates your company configures. Your company is responsible for reviewing documents before sending them and for its own pricing, contracts, and compliance with laws that apply to its business — including employment and tax law. Templates provided in the Service are starting points, not legal advice.

Availability and changes

We work to keep the Service fast and available, but it is provided "as is" without warranties of uninterrupted or error-free operation. We may update the Service, these terms, or the Privacy Policy; material changes will be reflected on these pages with an updated date.

Limitation of liability

To the maximum extent permitted by law, The Forge is not liable for indirect, incidental, or consequential damages, or for loss of profits, revenue, or data, arising from use of the Service. Our total liability for any claim is limited to the amounts paid for the Service in the twelve months before the claim arose.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms. On termination, your company may request an export of its data; retention of certain records may be required by law as described in the Privacy Policy.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.
